This boy had schizophrenia and during one of his episodes, his parents needed help in controlling him and made the mistake of calling the police to help them. It's a logical consideration, police obviously have training in how to physically restrain people and that was all they needed until he could calm down. So two police show up and try to talk to the boy and calm him down. A third then arrives and once they have sufficient numbers (I guess 2 vs 1 isn't stacked enough in their favor) they tackle him. The boy had a small screw driver and was using it to try to injure them, so once the boy was pinned down the third officer shot him and killed him. As usual, rather than being tried by a jury the police carried out an internal investigation. http://www.cnn.com/2014/01/08/justice/north-carolina-teen-killed/ Payne elaborated to CNN on Wednesday night, claiming that his client fired after Vidal made multiple attempts to stab the other officer with a screwdriver. The other officer was wearing a bulletproof vest and was not injured."We can say, based on our preliminary findings, that we are very confident that the officers did what they should have under state law," the law enforcement trade association's director, John Midgette, said Wednesday night. "It's a very tragic situation, but we do believe the officers." This child's parents, who just wanted some help dealing with his condition, had to pay for the uniforms of these officers, had to pay for their training, had to pay for their equipment and had to pay for the bullets that killed him. And for the rest of their lives they will have to pay for these cops' wages and when those cops decide they've had enough of oppressing and killing, these victims will have to pay for their retirement. Honestly, it amazes me that people still do not understand why I am an anarchist.

cab21 Posted January 18, 2014 Posted January 18, 2014 what does his weight have to do with this? a 90 pound person could easily kill with a screwdriver doupt it, want to take a test? i don't know what the situaiton was, but if the guy was stabbing in the nonvest area, sounds like it had potential for more damage than where the guy did stab ( the vest area) ok with giving it to a jury ok with having dro's handle the situation as dro's would see fit.

Secondly, the family's story said that the other two officers had the boy calm and possibly subdued, when the third officer came in yelling to taze the boy and shortly after is when he was quoted as saying, "We don't have time for this." and shot the boy. Supposedly, he was lining up for a second shot when the father pushed the officer out of the way to get to his son. I really think it would be hard to argue "policy" or "self-defense", but after seeing the Kelly Thomas verdict earlier this week, I'm not so sure.

I really think it would be hard to argue "policy" or "self-defense", but after seeing the Kelly Thomas verdict earlier this week, I'm not so sure. trail by jury might sort more of it out, sounds like it depends on the timing, and that it's just the cop that did that shooting that would be tried. the context of not having time is a factor, such as "this is not working, he is a threat to saftly" or " i don't want to deal with this, lets go with a nazi solution".
Xtort Posted January 20, 2014 Author Posted January 20, 2014 If the precinct thought this would make it through a trial they would have done it that way. Internal investigations are for when they know the cop would get hanged in court. As for the reference to his size and age, it's only to point out this kid was scrawny and he already had two trained thugs stepping on him. My son is not even 10 years old and he weighs more than this kid did. The idea that two officers trained in restraint techniques cannot control this boy and thus had to shoot him is completely asinine. If Hulk Hogan told you he had to shoot Skreech because the kid was just too difficult to control you'd be howling bloody murder.
