Judge orders Brady Center to pay ammo dealer’s legal fees after dismissing lawsuit
 

 

...Judge Richard P. Matsch dismissed the gun control group's suit that sought to hold Lucky Gunner legally responsible for the 2012 shooting. The Brady Center had argued in their suit that the way Lucky Gunner sells ammunition is "unreasonably dangerous and create a public nuisance."

He said the suit was filed for propaganda purposes. "It is apparent that this case was filed to pursue the political purposes of the Brady Center and, given the failure to present any cognizable legal claim, bringing these defendants into the Colorado court where the prosecution of James Holmes was proceeding appears to be more of an opportunity to propagandize the public and stigmatize the defendants than to obtain a court order," he said in his order.

Family to Pay Price for Trying to Sue Ammo Dealers

 

The family of 24-year-old Jessica Ghawi, a victim in the 2012 movie theater shooting in Aurora, Colorado, is faced with more than $200,000 in legal costs after a federal judge ordered them to pay attorney’s fees for four ammunition dealers the family attempted to sue.

“They have taken our daughter, and now they want to take our worldly goods,” Lonnie Phillips told MSNBC’s Tamron Hall in a televised interview earlier this week. “I think that’s a little much.”

 

If their daughter had been killed in a car accident, would they have sued the car dealership and manufacturer?

 

It's a tragedy that their daughter was murdered, but seeking retribution against people who were not responsible isn't justice. The Brady Center apparently had a hand in this (see original post).

If their daughter had been killed in a car accident, would they have sued the car dealership and manufacturer?

 

It's a tragedy that their daughter was murdered, but seeking retribution against people who were not responsible isn't justice. The Brady Center apparently had a hand in this (see original post).

 

An accident is not even an analogous situation. What would correspond better is if someone who got in a car and drove into a crowded sidewalk, so they sued the gas station.
